ACCEPTABLE USE POLICY
This Acceptable Use Policy (“AUP”) governs the use of the YESIM Application and YESIM Products and Services. This AUP forms an integral and binding part of the YESIM Terms of Service (“ToS”) and, together with the ToS and Product Descriptions, constitutes the Terms. Capitalized terms not defined herein shall have the meaning set forth in the ToS.
By using the YESIM Application, Products or Services, You acknowledge that You have read, understood, and agreed to this AUP.
1. Purpose of This Policy
The purpose of this AUP ais to:
- ensure lawful, fair, and responsible use of YESIM Products and Services;
- protect YESIM, its Users, partners, and third parties from abuse, fraud, and misuse;
- define prohibited activities and usage patterns.
YESIM may, at its sole discretion, determine whether a User's conduct violates this AUP.
2. General Acceptable Use Principles
You may use YESIM Products and Services only for lawful purposes and in a manner that:
- does not violate applicable laws or regulations;
- does not infringe the rights of others;
- does not expose YESIM or third parties to legal, regulatory, operational, or reputational risk.
Any use that is illegal, deceptive, abusive, or unreasonable is strictly prohibited.
3. Prohibited Activities (General)
The following activities are prohibited when using YESIM Products or Services, whether directly or indirectly:
- attempting to bypass, disable, or interfere with any technical, security, or operational measures of YESIM;
- copying, reproducing, modifying, adapting, reverse engineering, decompiling, disassembling or otherwise attempting to derive the source code of the YESIM Application, YESIM Products or Services or other Intellectual Property of Yesim, or interfering with the YESIM Application's performance or functionality;
- reverse engineering, testing, probing, or exploiting the YESIM Products or Services to identify limitations, vulnerabilities, or enforcement mechanisms;
- using YESIM Products or Services in any manner that adversely affects or is reasonably likely to adversely affect their availability, stability, reliability, or performance;
- engaging in illegal, fraudulent, deceptive, or misleading activities or any other abusive conduct, including but not limited to hacking into any aspect of the YESIM Application or YESIM Products or Services, spamming, distributing of unsolicited email, unsolicited advertisement, promotional information or other communications, transmitting or distributing viruses or other technologically harmful, destructive, malicious, spying, offensive or obscene materials, programs and/or codes, harmful agents or mechanisms that is designed to disrupt functionality, harm, disable or collect information;
- creating or using a false, misleading, or anonymized identity (including fake age-related information) with the intent to deceive YESIM or third parties;
- reselling, sublicensing, leasing, assigning, distributing, making available, or otherwise providing YESIM Products or Services to any third party, whether for consideration or free of charge, without the prior written consent of YESIM;
- facilitating, encouraging, or promoting any activity prohibited under this AUP;
- using the YESIM Services for any illegal activity, business, or purpose.
4. Prohibited Use of Virtual Number Service and Voice Service
Virtual Number Services are provided for lawful personal use, in accordance with the type of communications specified in the applicable Product Description (which may include automated verification calls, person-to-person voice calls, inbound SMS, or a combination thereof).
In addition to the general prohibitions above, the User shall not use, or attempt to use, a Virtual Number Service for:
- Unsolicited or abusive communications, including but not limited to spam, bulk, mass, or automated messaging activities or calling activities;
- Impersonation or misrepresentation, including creating or using a Virtual Number to mislead others as to the identity of the User or the origin of messages or calls;
- Circumventing or violating third-party rules, policies, terms of service, or enforcement mechanisms of any platforms, applications, or communication service providers;
- Automated or abusive harvesting of verification communications, including the use of scripts, bots, or other automated means to systematically collect, extract, harvest, or exploit verification or authentication messages or call flows at scale, or to operate or facilitate "SMS/call verification as a service" for third parties. This prohibition does not apply to the User's own legitimate receipt of OTP and verification communications in the ordinary course of personal use, as permitted under the applicable Product Description;
- Abnormal or excessive usage patterns, even where message or call volume is not excessive, if such patterns reasonably indicate misuse, abuse, or attempts to evade enforcement;
- Prohibited voice usage, including but not limited to: toll fraud, traffic pumping, or artificially inflating call volumes; CLI spoofing or manipulation of caller identification data; robocalling, auto-dialing, or any form of unsolicited automated voice communications; calls to or from premium-rate, shared-cost, or revenue-sharing numbers unless expressly permitted by YESIM; use of the Voice Service for call centre operations, telemarketing, or systematic commercial calling without the prior written consent of YESIM;
- Prohibited Virtual Number exploitation, by way of using a Virtual Number or Voice Service to create, verify, or maintain fake, fraudulent, or unauthorized accounts on any third-party platform or service, or to facilitate any fraudulent scheme. For the avoidance of doubt, the legitimate use of a Virtual Number by the User to receive OTP or verification communications for the User's own genuine accounts does not constitute a violation of this paragraph;
- Reselling, redistributing, or otherwise making available Virtual Numbers or the Voice Service as a replacement for, or substitute to, domestic telecommunications services;
- Any activity that is illegal, fraudulent, deceptive, or otherwise inconsistent with the intended purpose of the Virtual Number or Voice Service as set out in the applicable Product Description.
5. Compliance With Third-Party Policies
The User is solely responsible for ensuring that their use of YESIM Products and Services complies with:
- applicable laws and regulations; and
- the terms, policies, and rules of any third-party services or platforms with which the YESIM Products or Services are used.
YESIM does not control and is not responsible for third-party policies, restrictions, suspensions, or bans, including any actions taken by upstream telecommunications carriers or number providers.
6. Monitoring and Enforcement
YESIM reserves the right, but does not undertake the obligation, to monitor usage of its Products and Services, in accordance with applicable data protection laws, for compliance with this AUP.
If YESIM determines, at its sole discretion, that a violation of this AUP has occurred or is likely to occur, YESIM may, without prior notice, take one or more of the following actions:
- suspend, restrict, or terminate the User's Account;
- suspend, restrict, or terminate any Virtual Number or Voice Service;
- suspend or terminate access to any YESIM Products or Services;
- report suspected illegal activity to the relevant law enforcement or regulatory authorities and/or apply contractual penalties in accordance with the ToS;
- take any other measures deemed reasonably necessary to protect YESIM, its Users, partners, or third parties;
- share relevant usage data, Call Metadata, and KYC data with upstream telecommunications carriers or number providers where required under such providers' policies or applicable law.
Such actions shall not give rise to any right of refund, compensation, or damages. Where practicable, YESIM will notify the User of the action taken and the reason for it, unless such notification is prohibited by law or would compromise an ongoing investigation.
7. No Limitation of Other Rights
Nothing in this AUP shall be construed as limiting YESIM's rights under:
- the ToS;
- applicable law; or
- any other agreements between YESIM and the User.
Any violation of this AUP constitutes a material breach of the ToS.
8. Changes to This Policy
YESIM may update or modify this AUP at any time by publishing a revised version via the YESIM Application or on the YESIM website or by other reasonable means of notification. Continued use of YESIM Products or Services after such publication constitutes acceptance of the updated AUP. If You do not agree to the updated AUP, You must discontinue use of YESIM Products and Services before the updated AUP takes effect.
